TERMS AND CONDITIONS FOR: MYSTIC REBIRTH RETREAT, 

Yucatán, Mexico March, 17-26, 2025  Trip leader: Beatriz Davila 

Let me paint a picture of the enchanting destination awaiting us. 

Merida, the jewel of the Yucatan Peninsula, is not just a city. Located 2 hours away by plane from Mexico City, it is a living testament to the beauty of colonial architecture and the vibrant soul of Mexican culture. With its cobblestone streets, pastel-hued facades, and bustling vibrant markets, Merida exudes an irresistible charm that captivates all who wander its streets. 

Rich in folklore, flavour and stunning colonial and modern taste, Merida is a gateway to the mystical wonders of the Yucatan jungle. Nestled amidst ancient ruins and verdant foliage, our retreat will unfold at a breathtaking hacienda, where the whispers of the Mayan Nature echoes through the mystical Ceiba trees, sacred cenotes (underwater caves), and the renowned Mayan Pyramid.

Here, surrounded by the sacred beauty of nature, we'll embark on a journey of self-discovery, renewal and reWilding.

During our 5 nights in La Hacienda Shambalante, at the heart of the mystical Mayan jungle, prepare to immerse yourself in daily adventures that will nourish your spirit and awaken your senses. From exploring hidden cenotes to indulging in the flavours of authentic Mexican cuisine, each moment will be infused with the magic of this sacred land.

Our magical journey will include a truly awe-inspiring event: the spectacle of the Spring Equinox at one of the most sacred ceremonial centres of the Mayan Culture. Spring represents new beginnings, a new cycle, and the Serpent represents the wise feminine Shakti-Eneregy that lives within us.

But our journey doesn't end there. After our time in the jungle, we'll venture into the heart of the City of Merida for an additional 3 nights! Here, amid the timeless elegance of colonial mansions and the vibrant energy of the city's plazas and night markets, we'll dive deeper into the rich tapestry of Mayan culture and gastronomy. A full fiesta of delight that will warmth your whole being.

What’s Included: 

Mystic Mayan Retreat is an all-inclusive experience designed to nourish your mind, body, and spirit. We've taken care of the details, so you can focus on your transformation.

SHAMBALANTE:

• 6 nights in a twin shared room or private room (according to your selection of accommodation)
• 4 lacto-ovo-vegetarian meals a day are included: breakfast, lunch, dinner and a light snack.
• Transportation from Merida airport to Shambalante Hacienda (on Monday March 17)
• Daily Women’s Circles, Yoga, Meditation and Breathwork  sessions
• All transformational teachings & ceremonies:  welcoming and Opening Ceremony, Fire Ceremony, Temazcal and  Mayan Closing Ritual.
• Entrance to Mayan Sites with certified English guides to: Yaxunah, Uxmal, Chichen Itza, Cenote Santa Barbara
• Spring Equinox Special Event at Chichen Itza 
• Direct transfers from Merida Airport to Shambalante Hacienda 
• Transfer from Shambalante Hacienda to Merida Hotel.

MERIDA

• Continental Breakfast included (not other meals, refreshments or snacks are included)
• Guided visit to the Chocostory Museum and Uxmal Archeological site
• Colonial Tour to Explore Merida’s most famous Casonas/Haciendas
• X1 Dinner at Casa Yucatan
• Access to the “Jarana Regional Dance” at the Plaza of Merida

What’s Not-Included

• We are not responsible for your round trip flight from your home Country to Mexico AND the Interstate Airfare from Mexico to Merida and back.
• Accomodation in Mexico City or any place before and after the Retreat dates.
• Meals/snacks/drinks outside of the Retreat Centre and Hotel in Merida
• -Personal spending money, shopping, souvenirs, personal phone calls, extra spa services, taxis, and laundry.
• All tips for the drivers, guides, maids and bell boys are not-included.
• Alcoholic beverages, non-included drinks, souvenir shopping and laundry services are not included. 
• Local transportation outside the tour activities are not included.
• Also not included are: items of a personal nature such as, gifts, toll calls, excess baggage, medical costs, the costs of hospitalization and evacuation from remote areas, travel insurance and additional expenses arising from the delay or extension of a trip due to weather, political disputes, sickness, failure of transportation, or other causes beyond our control. 
• SPA services are not included at any of the venues
• Tips and gratuities (15%) are not included
• Gratuity for any additional massage services is not included. 
• Other non-included items would be: any other activities, healing sessions, and tours not included in our package.
• Any type of Visas or Passport documentation 
• MEDICAL INSURANCE is a must and prerequisite prior booking your Retreat.
• TRAVEL INSURANCE WITH TRIP CANCELLATION COVER IS A MUST

Payment

A non-refundable deposit of $500.00 USD with your trip registration forms is needed to hold your spot. 

Cancellation and Refunds

Any cancellation received in writing from December 16th, 2024 and January 16th, 2025 will result in in a loss of 50% of the total trip cost. 

Any cancellation between January 17th 2024 and the trip departure March 16th, 2025 will result in a total loss of funds. 

Final payment is due by February 1st, 2025 . 

All payments are made by direct transfer to RESPIRAH YOGA SPACE, BEATRIZ DAVILA ALVA

We cannot make exceptions to this policy.

We reserve the right to cancel the trip if it is not meeting the trip minimum (if we do so your deposit is refunded). Trip cancellation insurance is strongly recommended if there is a possibility that you might have to cancel your trip. All cancellations must be made to (BEATRIZ DAVILA ALVA ALVA) in writing and any refund requests must be made in writing to (BEATRIZ DAVILA ALVA) within 30 days of the return date. RESPIRAH YOGA SPACE reserves the right to cancel any trip prior to departure for any reason whatsoever, including an insufficient number of participants or logistical problems (e.g. acts of God, war, strikes, etc.), which may impede trip operations.  The refund of all payments as described in the paragraph below shall release ( RESPIRAH YOGA SPACE from any further liability.  A trip cancellation due to insufficient numbers would normally occur at least a month prior to departure, unless acts of God, war, strikes or other events impede our departure causing large numbers of participants opt to cancel participation on the journey in the last days before departure. 

RESPIRAH YOGA SPACE must make substantial payments to suppliers (including providers of land travel) far in advance of the scheduled date on which we embark. If a trip is cancelled due to forces beyond our control (acts of God, war, labor strikes, earthquake, flooding, etc RESPIRAH YOGA SPACE will promptly refund the portion of the trip cost not advanced to suppliers RESPIRAH YOGA SPACE will use its best efforts to recover advance payments as promptly as possible, and will refund to you the amount recovered, if any.  However RESPIRAH YOGA SPACE does not guarantee recovery of any or all of the advance payments made, and our use of best efforts to recover these payments will not include the institution of any legal proceeding in foreign lands.  This policy applies to a trip cancellation by client choice following any necessary increase in trip costs.

RELEASE OF LIABILITY AND ASSUMPTION OF ALL RISKS

PLEASE READ CAREFULLY: THIS IS A LEGALLY ENFORCEABLE WAIVER OF RIGHTS

ASSUMPTION OF RISKS

I (the undersigned), acknowledge that I have voluntarily applied to participate on the trip designated on this application.  I am voluntarily participating on the tour or expedition with knowledge that travel to foreign countries and/or the remote areas visited by this trip involves numerous risks and dangers including, but not limited to, a risk of illness, injury or death, which may be caused by: forces of nature, civil unrest, terrorism, road conditions, injuries inflicted by animals, insects, reptiles or plants, trails, hotels, vehicles, boats or other means of conveyance which are not operated nor maintained to standards common in Australia; high altitude accident, accident or illness without access to means of rapid evacuation or the availability of medical supplies; the lack of adequacy of medical attention once provided, and negligence on the part of RESPIRAH, BEATRIZ DAVILA ALVA, their affiliated organizations and their employees, teachers, volunteers or other agencies. I acknowledge that the enjoyment and excitement of foreign travel/adventure travel is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work, and that these inherent risks and the corresponding enjoyment and excitement contribute to the reason for my voluntary participation on this trip.

I HEREBY ACCEPT ANY AND ALL RISKS OF ILLNESS, INJURY, EMOTIONAL TRAUMA OR DEATH AND VERIFY THIS STATEMENT BY MY SIGNATURE BELOW

RELEASE

AS LAWFUL CONSIDERATION for being permitted by RESPIRAH YOGA SPACE, BEATRIZ DAVILA ALVA, to participate on such trips and activities, I hereby agree that I, my heirs, legal representatives or any member of my family will not make a claim against or sue RESPIRAH YOGA SPACE, BEATRIZ DAVILA ALVA, or any of their affiliated agents, employees, teachers or volunteers, for bodily injury, death, emotional trauma or property damage resulting from my participation in the tour or expedition.  

I therefore release and discharge RESPIRAH YOGA SPACE, BEATRIZ DAVILA ALVA and their agents, employees, teachers and volunteers from and against any and all liability arising from my participation in the tour or expedition even though that liability may arise out of negligence or carelessness on the part of RESPIRAH YOGA SPACE, BEATRIZ DAVILA ALVA or their affiliate agents, employees, teachers or volunteers.

If any portion of this agreement is unenforceable, the remaining portions shall remain in full force and effect.  Under no circumstances shall RESPIRAH YOGA SPACE, BEATRIZ DAVILA ALVA be liable to any tour participant for more than the land cost of the trip applied for on this document. I waive any charge-back rights and, in the event of dispute, requests for a refund will be made using the procedures described under “Cancellation and Refunds” as stated in the Terms and Conditions for this trip. All applications are subject to acceptance by RESPIRAH YOGA SPACE, BEATRIZ DAVILA ALVA, Upon acceptance of my application, this agreement shall be deemed to have been entered into at Brisbane, Queensland, Australia, and shall be construed according to the laws of the State of Queensland.  In the unlikely event a legal dispute should arise involving any subject matter whatsoever, I agree that the exclusive venue for any legal action shall be Brisbane, Queensland, Australia

TRAVEL INSURANCE

We recommend Trip Cancellation insurance or Trip Interruption insurance for this trip. Travel insurance is designed to reimburse you for non-refundable expenses in case of a trip cancellation as well as for other previsions such as: missed flight connections, medical expenses/emergency assistance coverage (if something happens to you personally), baggage & personal effects coverage (if they are lost or stolen), baggage delay (if your bags do not arrive with your flight and you have to buy clothing, and personal items) which could possibly be very costly. Please note that insurance policies vary tremendously and have various critical exclusions. We recommend you choose carefully based on your personal situation. 

I HEREBY ACCEPT ANY AND ALL RISKS ASSOCIATED WITH MY REFUSAL TO PURCHASE THE INSURANCE SUGGESTED IN THE ABOVE PARAGRAPH BY MY SIGNATURE BELOW

KNOWING AND VOLUNTARY EXECUTION

I have carefully read and fully understand the contents of this agreement as well as all the conditions as stated under the heading "Terms and Conditions" (see attached pages) including those conditions regarding responsibility borne by trip participants and conditions regarding cancellations and refunds.  I am aware, that this is a release of liability and a legally binding and enforceable contract between myself and RESPIRAH YOGA SPACE, BEATRIZ DAVILA ALVA and I sign it of my own free will.

RESPONSIBILITY/ LIMITATION OF LIABILITY

RESPIRAH YOGA SPACE, BEATRIZ DAVILA ALVA with its principle place of business in Brisbane, Queensland, Australia gives notice that services provided in connection with these itineraries are rendered by suppliers who are not agents or employees of RESPIRAH YOGA SPACE, BEATRIZ DAVILA ALVA All of the accommodations, meals, tours, transportation and/or related travel services have been made by RESPIRAH YOGA SPACE, BEATRIZ DAVILA ALVA ,only as an agent for the individual tour member.  While every effort is made to make travel arrangements with reputable suppliers, a tour member expressly agrees that RESPIRAH YOGA SPACE, BEATRIZ DAVILA ALVA shall not be liable for any delay, mishap, inconvenience, expense, irregularity, bodily injury or death to person, or damage to property occasioned through the negligence, wrongful or intentional acts, or default of any company or individual engaged in providing these arranged services. Each passenger conveyance, tour company, hotel accommodation, restaurant, etc. is subject to the laws of the state or country where the service is provided.

RESPIRAH YOGA SPACE, BEATRIZ DAVILA ALVA, shall not be liable, directly or indirectly, for bodily injury or property damage for any reason whatsoever, including, but not limited to the following causes: acts of God, pandemics, epidemics, detention, annoyance, weather, quarantines, strikes, civil disturbance, theft, negligence including negligence of (YOUR NAME), default, changes in government regulations, terrorism, war or failure of conveyance to arrive or depart as scheduled.

RESPIRAH YOGA SPACE, BEATRIZ DAVILA ALVA reserves the right to substitute hotels and group leaders and to alter the itinerary when deemed necessary or advisable.  The right is also reserved to cancel any trip prior to departure RESPIRAH YOGA SPACE, BEATRIZ DAVILA ALVA is released from any and all liability for cancellation of any trip, or portion thereof, except for payment of a land cost as set forth in the section on "Cancellation and Refunds."

RESPIRAH YOGA SPACE, BEATRIZ DAVILA ALVA , reserves the right to decline to accept or retain any person whose actions, physical heath, mental condition or general deportment impede trip operation or rights, welfare or enjoyment of other trip members.  A refund based on the cost of unused land services is the limit RESPIRAH YOGA SPACE, BEATRIZ DAVILA ALVA responsibility.

RESPIRAH YOGA SPACE, BEATRIZ DAVILA ALVA , is not responsible for any refunds should a presenter advertised as attending or leading a tour or conference cancel for any reason. However should BEATRIZ DAVILA choose to cancel her participation in this journey for any reason, every effort will be made to refund your deposit and payments made which have not been previously sent to foreign and air travel suppliers as outlined above. Which is a must having a cancellation insurance for the duration of this trip.

BEATRIZ DAVILA is not responsible for any physical, mental, emotional, or any other reaction, trauma, or ailment during the trip or occurring afterwards, that participants may experience at the sites or from any leaders, workshops, or sessions of any kind, including private sessions with facilitators or presenters. Attendance on the trip indicates acceptance of this and all other provisions of this responsibility clause.

RESPIRAH YOGA SPACE, BEATRIZ DAVILA ALVA ,has recommended the purchase of appropriate travel accident insurance, baggage insurance, tour operation carrier default protection insurance, and trip cancellation insurance, and has made available explanatory information and policies, and the travel program member has the opportunity to purchase such insurance as protection against certain risks of travel to the planned destination. Travel program members are advised that travel insurance covers only what is included as stated in the travel insurance brochure.

The airlines or transportation companies concerned are not held responsible for any acts, omissions or events during the time passengers are not on board their planes or conveyances. The passenger contract in use by the carriers concerned, when issued, shall constitute the sole contract between the airlines or transportation companies and the purchase of this travel program and/or passengers.

TRIP MEMBER RESPONSIBILITY

Trip members have the responsibility to select a trip appropriate to their abilities and interests.  Trip members are held responsible for being in sufficient good health to undertake the trip. Trip members are responsible for preparing for this trip by studying the itinerary and pre-departure information sent by RESPIRAH YOGA SPACE, BEATRIZ DAVILA ALVA and for discussing this itinerary with their personal physician. Trip members agree to accept and abide by all the terms and conditions outlined in the “Terms and Conditions” document for this journey. Trip members are responsible to obtain any required travel documents and visas if necessary and to make sure all documents are current and up to date. Trip members are responsible for complying with any health requirements and vaccinations of any countries visited on this journey. Trip members are also responsible for bringing the appropriate clothing, medicines, supplies and equipment as advised in the pre-departure information.  Trip members are participants in group travel and are expected to hold each other in compassionate regard, and to interact with each other with respect.
